LOS ANGELES, May 23, 2013—On May 23rd, the two-year anniversary of California's Mortgage Fraud Strike Force, and as homeowners and Occupy Our Homes press for justice at the Department of Justice in Washington, D.C., Occupy Fights Foreclosures (OFF) marches to Attorney General Kamala Harris' office to pose the same question Senator Elizabeth Warren asked federal bank regulators in her first banking committee hearing (http://youtu.be/dxhyUAWPmGw): why have no banks been taken to trial in the aftermath of the financial crisis?
Close to $90 million of the $18 billion that came to CA from the 49-state mortgage settlement went directly to the AG office's budget — five times the minuscule $18.4 million that reportedly went to homeowners. (http://www.propublica.org/special/where-are-the-foreclosure-deal-millions-going) The number of important prosecutions? Zero. Only three low level attorney scammers have been arrested. The number of bankers in jail? Zero. The number of banks brought to trial? Zero. What exactly has the Attorney General's office been doing for $90 million dollars?
On Monday, May 20th, 500 residents and activists took to the streets in our nation's capital to demand that Eric Holder hold Wall Street accountable and the Department of Justice actually serve justice to the bankers that are taking our homes. Homeowners have been arrested for insisting on justice when it should be the bankers being arrested for billions of dollars worth of crimes. We demand banks be held accountable in our own state: Kamala Harris must serve justice to the big banks that have stolen millions of Californian's homes.
We acknowledge that AG Harris has brought suit against JPMorgan Chase for fraudulent and unlawful debt-collection practices against credit card borrowers (http://oag.ca.gov/news/press-releases/attorney-general-kamala-d-harris-announces-suit-against-jpmorgan-chase). But this is a tiny tip of the iceberg. Chase and other big banks do identical unlawful debt-collection practices when collecting on the debt of a mortgage / deed of trust by foreclosing. Robosigning is at the heart of the credit card suit. Robosigning of fraudulent documents is at the heart of virtually all foreclosure cases in all courts.
"We are here to point out the obvious," says Carlos Marroquin, Occupy Fights Foreclosures activist. "As Senator Warren said, when banks can break the law and take in billions and billions of profits, then turn around and settle using tiny sums of money out of those profits, they don't have much incentive to follow the law. Trials give us days and days of testimony when bank employees are grilled to find out exactly what they've been up to. That information needs to be public record. We ask AG Harris what Sen Warren asked regulators: how tough are you?"
Occupy Fights Foreclosures calls on AG Harris to within the next 6 months bring identical prosecutions against the big banks for the identical practices in mortgage and foreclosure crimes as she is prosecuting for credit card crimes. We also expect her to issue a public call to judges to regard allegations of robosigning as a serious cause of action.

LOS ANGELES- February 28th, 2013- Occupy Fights Foreclosures (OFF), has been working hard to defend the rights of homeowners defrauded by banks. Many of the foreclosure victims we are helping have Limited English Proficiency (LEP), and they are being denied the services of court interpreters in their court hearings. When these homeowners go to court to fight fraudulent foreclosures and evictions by the banks, they are not able to understand the proceedings, let alone defend themselves, and the banks are taking full advantage of this.
The Justice Department has already reached a settlement of $335 million with Countrywide in 2011 for discrimination against minority borrowers. Yet, state courts continue to discriminate against immigrants by denying them court interpreters. The Supreme Court has ruled that failing to take reasonable steps to ensure meaningful access for LEP persons is a form of national origin discrimination prohibited by Title VI regulations. According to Title VI regulations, state courts are violating the civil rights of thousands of LEP persons on a daily basis. For LEP homeowners, this violation of their rights may cost them their homes.
The Superior Court of Los Angeles states on its Web site that its mission is to “Equally serve all people and consistently work to identify and remove barriers to access.” Occupy Fights Foreclosures demands the courts to put this into practice. We are sending a letter to Assistant Attorney General Thomas Pérez, requesting that the Department of Justice move immediately to require the California Superior Courts to comply with federal law and provide “universal, free and qualified” court interpreting, as the Department of Justice already instructed them to do on August 16, 2010. OFF is sending a copy of our letter to the California Judicial Council and the presiding judges of Los Angeles, San Bernardino, Orange and Riverside Counties.
According to homeowner defense attorney Lenore Albert, the bank’s attorneys are routinely posing as Legal Aid representatives who are there to help the homeowner. They tell the homeowner to sign stipulations to judgment, and that after they sign the paperwork, the judge will hear their case. However, after they sign the stipulation, their case is done and they never have an opportunity to say anything to the judge. Ms. Albert observes, “The failure to provide qualified interpreters leads to this prevalent practice."
"LEP Homeowners who have lost their homes and their present cases being violated are in the thousands. The violations are occurring at every level of the judicial foreclosure process, including Unlawful Detainer, Bankruptcy, Civil and Federal Courts", said Carlos Marroquin, homeowner advocate with the Occupy Fights Foreclosure Home Defense movement.

Los Angeles - B of A's lackeys, the L.A.P.D., wrongfully evicted the Corona family Friday, Jan 18th at around noon. Soledad's teenaged daughter, Victoria, was the only one home at the time and they told her she had to leave immediately. This is the SECOND time the Corona family has been evicted during the so-called "Holiday Moratorium" on foreclosures and evictions announced by major banks. The LAPD claimed they were "trespassing" in their own home. One officer allegedly said there was an arrest warrant for Soledad Corona, although they denied this later that evening.
